Lion, Doby and Company specializes in compliance audits in the industries of licensed merchandise royalties, as well as music recording and intellectual property. With over 20 years of experience, we offer the experience and sophistication of a large firm, but with the accessibility and cost-efficiency that only a small firm can provide. Our clientele ranges from large Fortune 500 companies to small businesses or individuals.
Our experience has shown that our fees are far less than amounts recovered by our clients, often up to 10 to 20 times less, and many times even more. In practically all instances, our clients recover significant sums of previously unreported royalty income. Examples of potential licensee royalty under payments are a result of:
• Unreported sales
• Use of incorrect royalty rates
• Unpaid royalties, minimum guarantee and advance payments
• Sales of unlicensed merchandise
• Sales in unauthorized territories
• Non-compliance with promotion/advertising commitments
• Inappropriate or unallowed deductions
• Unauthorized sales during and after the sell-off period
• Foreign exchange rates
Inaccurate royalty reporting can result from inadequate internal controls, miscalculations and/or misinterpretations of the royalty agreement. Performing royalty compliance investigations help correct these issues and facilitate appropriate reporting and payments of royalties by licensees.
The process begins with the licensee providing us with the royalty agreement and royalty statements that have been submitted. At no cost to the licensee, we will evaluate whether or not there is a likelihood of underpayments and a proposal as to a course of action.
